Abstract
Le régime de la responsabilité civile extra-contractuelle des particuliers et corporations civiles d’une part, et des corporations politiques d’autre part, repose, selon le cas, sur des assises juridiques distinctes. Les sources de cette responsabilité remontent à l’époque lointaine où se jetaient les fondements des droits public et privé québécois. L’analyse circonstanciée de l’article 356 C.c.B.-C. en permet une interprétation fidèle aux droits français et britannique dont a hérité le Québec. Les efforts déployés par le législateur contemporain pour adapter la responsabilité de la puissance publique aux conditions du XXI e siècle, manquent, selon l’auteur, de perspectives juridiques et politiques.
