Abstract
Le droit civil du travail, c’est-à-dire le droit de la relation contractuelle employeur-employé, a peu changé depuis le début de ce siècle et l’on applique encore aujourd’hui des règles qui, souvent, n’entretiennent guère de rapport avec les réalités contemporaines du travail. Cela, pourtant, n’est pas irrémédiable, notre droit civil, tel qu’incarné dans le Code civil , possédant un dynamisme qui permet d’espérer, et même de justifier, une nécessaire évolution. L’auteur tente d’illustrer cette proposition au moyen d’une remise en question des règles relatives au caractère intuitu person ae du contrat de louage de services et à l’impossibilité d’obtenir judiciairement la réintégration de l’employé congédié sans motif. Cette remise en question est fondée à la fois sur l’observation des phénomènes actuels du travail et sur des arguments strictement juridiques.
