Abstract
Dans cet article, l’auteur analyse à la lumière de la philosophie nouvelle des contrats dégagée par le professeur J. Ghestin, l’évolution du droit positif québécois en la matière, et en relève les tendances nouvelles. Dans cette perspective, il étudie les changements jurisprudentiels, l’apport de la nouvelle Loi sur la protection du consommateur, ainsi que les orientations futures offertes par le projet de réforme du Code civil. Il souligne ensuite les changements apportés par cette philosophie nouvelle aux règles de la formation des contrats et à leurs sanctions.
