Le système d’arbitrage de différends, chez les policiers et pompiers en particulier, a été l’objet de sévères critiques ces dernières années. Malgré le stoïcisme derrière lequel les arbitres se sont jusqu’ici retranchés, pour ne pas intervenir dans un débat partisan et le plus souvent politique, ces derniers n’en demeurent pas moins des témoins impartiaux et de première ligne, désireux tout autant que les parties elles-mêmes d’apporter leur contribution à la recherche de nouvelles voies de règlement de ces conflits. Ces quelques réflexions porteront sur les parties en présence, les objets du différend, le déroulement des auditions et le processus décisionnel lui-même. Elles sont le fruit d’une mise en commun des expériences vécues par chacun, avant comme après les dernières modifications apportées au Code du travail du Québec.
