Abstract
Tant en France qu’au Québec, le droit de la filiation se transforme. La présomption de paternité et de légitimité, autrefois pivot des règles de la filiation, ne joue plus ce premier rôle. On considère en effet aujourd’hui que la filiation juridique doit, dans la mesure du possible, correspondre à la vérité biologique; or trop souvent, la présomption de paternité masquait cette réalité. Elle perd donc maintenant de l’importance. On constate en effet, tant en France qu’au Québec, une dévalorisation de la présomption de paternité, justifiée par la recherche de la vérité. L’étude comparative de cette question est l’objet de cet article. On y analyse la valeur du principe de vérité biologique comme base de la filiation juridique ainsi que son influence, en France et au Québec, sur la présomption de paternité.
