Abstract
Malgré que l’on puisse considérer le droit d’association comme une liberté fondamentale, l’État tente de contrôler, limiter et réglementer la formation et l’action des associations. La reconnaissance ou non d’une association en tant qu’organisme de charité a un grand impact sur les avantages économiques et fiscaux qui lui seront accordés. Cette étude vise l’examen des conditions de reconnaissance d’un organisme de charité et de la bataille de la dernière décennie au cours de laquelle l’État a tenté de restreindre la reconnaissance de ces organismes au motif qu’ils poursuivaient des objectifs politiques.
