Abstract
Dans le cadre des nouvelles relations juridiques entre locateurs et locataires, instaurées par la Loi de la Régie du logement, les mesures de fixation et de modération du loyer sont celles qui soulèvent le plus d’intérêt. Même si les nouvelles dispositions reprennent substantiellement celles qui existaient sous la Loi de conciliation, l’extension de la juridiction de la Régie à l’ensemble des logements locatifs et l’établissement de critères de fixation de loyer entraînent à l’heure actuelle un contrôle à peu près généralisé et jusqu’alors inconnu des hausses des loyers par l’État. Il s’agit cependant d’un contrôle assez souple, les mesures de fixation des loyers tenant compte, à partir d’une base qui est le loyer antérieur, des hausses subies par le propriétaire au titre des frais d’exploitation, des améliorations et réparations, de même que la hausse due à l’indexation du revenu net. Ces mesures ne devraient pas dans une situation normale avoir d’impact négatif sur l’investissement dans le secteur du logement.
