Abstract
Ce travail fait une description critique des trois niveaux où peuvent intervenir les tribunaux pour assurer la protection des droits de la personne, soit en contrôlant la constitutionnalité des lois, leur quasi-constitutionnalité, i.e., leur conformité avec des lois générales sur les droits de la personne et enfin la légalité des actes de l’administration. L’auteur estime qu’une protection judiciaire des droits de la personne fondée sur la théorie du partage des compétences entre les autorités fédérales et provinciales est une solution politique erronée à une question fondamentale, que la Déclaration canadienne des droits a été en pratique peu appliquée par les tribunaux et que ceux-ci ont eu surtout une action salutaire dans le contrôle des actes de l’administration. Enfin cette étude conclut à l’importance pour un régime démocratique d’avoir un pouvoir judiciaire toujours soucieux de faire respecter le principe de légalité.
