Abstract
La législation du travail réglemente nettement le recours à la grève, arme traditionnelle des salariés lors d’un conflit de travail. Mais, qu’en est-il de la légalité de diverses tentatives d’isoler encore plus radicalement l’employeur, de faire en sorte que ses clients ou d’autres personnes en rapport d’affaires avec lui le boycottent, ou même, plus largement, que le public s’abstienne d’acheter son produit, offert par diverses autres entreprises ? La législation du travail, du moins celle qui s’applique au Québec, aurait-elle une incidence indirecte sur de tels comportements, dont elle ne traite pas expressément ? Quelle est la portée du droit commun ? Ces interrogations se posent, que la tentative de mise à l’index accompagne une grève ou qu’elle survienne en l’absence de celle-ci.
