Abstract
Une réforme importante relative aux corporations professionnelles est entrée en vigueur le 1er février 1974. Cette réforme mettait l’accent nettement sur la protection du public. Cette protection est assurée d’une part par le contrôle de la compétence et de la conduite des membres par les corporations professionnelles; nous ne verrons pas cet aspect ici. La protection du public est assurée d’autre part par le contrôle de l’exercice illégal des professions et l’usurpation des titres réservés. Ce second aspect est l’objet du présent article. L’exercice illégal des professions est d’une nature plus complexe qu’autrefois. Les interrelations entre les diverses professions sont maintenant plus grandes. Les champs d’exercice exclusif ne sont plus aussi étanches qu’autrefois. Les professions à titre réservé font face à des problèmes nouveaux et imprévus. L’aspect procédural a aussi son importance puisqu’il détermine dans une grande mesure l’efficacité de la protection accordée par la loi aux champs d’exercice exclusif et aux titres réservés.
