Abstract
Cet article postule que les politiques nationales et supranationales facilitent la mobilité des migrants défunts alors qu’elles contraignent et limitent de plus en plus la mobilité des migrants vivants, surtout quand ils sont malades, marginaux ou originaires de pays pauvres. Cette hypothèse est défendue à partir de deux cas mexicains-étatsuniens en montrant : a) qu’une fois décédés, migrants et marginaux, placés en dehors de l’ensemble des citoyens de leur vivant, sont autorisés par les États à le réintégrer ; b) que, si les États se fondent sur les lois en vigueur pour la circulation des vivants, lorsqu’il s’agit de celle des morts, ils s’appuient sur des valeurs universelles qui rendent légitime l’appartenance des défunts à une communauté nationale plus large.
