Abstract
L’auteur constate que règles de droit privé et règles de droit public se heurtent en matière de responsabilité de la Couronne. Pour régler les problèmes que pose cette responsabilité du fait des fonctions discrétionnaires attribuées par la loi, les juges ont créé le concept de public policy et ont emprunté au droit anglais qui l’a lui-même empruntée au droit américain la dichotomie exécution/planification. Les textes législatifs imposent cependant aux juges des contraintes. Le paragraphe 3(6) de la Loi sur la responsabilité de la Couronne serait toutefois plus une règle d’interprétation qu’une exception au principe de l’immunité de la Couronne. L’auteur souligne par ailleurs le caractère légal et subsidiaire de la responsabilité de la Couronne; il analyse en particulier l’alinéa 3(1)a) de la Loi sur la responsabilité de la Couronne, qui ne vise que des situations ayant leur contrepartie dans le secteur privé. La loi de 1953 est ainsi devenue désuète.
