Dans nos démocraties, la protection des droits de la personne s’effectue d’au moins cinq façons : par une déclaration intégrée dans la Constitution et assortie d’un contrôle judiciaire de la constitutionnalité, ou encore par intégration sans contrôle judiciaire; en troisième lieu cette protection peut être laissée au seul législateur; une quatrième façon consiste à inscrire une Déclaration dans la Constitution avec clause dérogatoire et enfin, une cinquième voie vise à protéger les droits par une législation spéciale à laquelle on ne peut déroger que par une déclaration expresse. Le Canada a emprunté la cinquième voie. Les droits de la personne sont protégés par des déclarations dans l’ordre fédéral et dans l’ordre provincial de gouvernement. De plus, plusieurs commissions des droits de la personne ont été mises sur pied par les deux ordres de gouvernement. Même si nous n’avons pas une Déclaration des droits « intégrée » dans la Constitution, les tribunaux ont déclaré que certaines libertés sont garanties implicitement. Notre Constitution contient, au surplus, quelques dispositions expresses sur les droits démocratiques, religieux et linguistiques. Au Canada un débat se déroule actuellement sur l’opportunité d’intégrer les droits de la personne dans la Constitution et d’emprunter la première voie. Devons-nous nous rapprocher de l’école américaine et française ou rester plus près de l’école britannique où prévalait, du moins jusqu’à tout récemment, la souveraineté parlementaire ? De plus, chez-nous ce débat est relié à la réforme constitutionnelle, ce qui lui donne une dimension additionnelle qui nous est propre.
