DO STATUS INSTITUCIONAL DAS FORÇAS ARMADAS NA HISTÓRIA CONSTITUCIONAL BRASILEIRA

Abstract
O artigo pretende, em linhas gerais, analisar o desenvolvimento do status institucional das Forças Armadas no decorrer da história constitucional brasileira, de modo a verificar se o antigo manejo das instituições militares como instrumento de estabilização política ocorria ou não em consonância com as premissas fixadas pelas Constituições anteriores. Tendo em vista a atual subordinação das Forças Armadas aos Poderes Constitucionais, o texto objetiva, ainda, a partir de uma exegese intrínseca às respectivas realidades históricas, verificar se tal emprego era conveniente para o homem político, inclusive para os políticos militares, trazendo à tona, por oportuno, diversos debates travados a respeito do tema durante a realização da Assembleia Nacional Constituinte. Por fim, analisar-se-á como ocorre, no âmbito da defesa nacional e da garantia da lei e da ordem, o emprego das Forças Armadas, bem como sua ampla subordinação aos Poderes Constitucionais.
