Abstract
The January 27, 2017 Necessity and Urgency Decree (DNU 70/2017), with its emphasis on immigrants’ criminality and the need to protect Argentina’s nationals from “menacing” foreigners, modified the liberal 2004 Immigration Law (#26,871) that had proclaimed respect for migrant rights and facilitated legal regional migration to Argentina. Can DNU 70/2017, therefore, be seen as an exceptional measure in the otherwise welcoming country? Or alternatively, are control measures, even those violating the rights of some migrants consistent with even the most liberal immigration policies? This chapter argues the latter by tracing the continuities between the recent decree and the previous measures and attitudes.
