Sob a ótica do transporte aéreo brasileiro, o presente artigo analisa o Recurso Extraordinário 636.331 STF à luz do diálogo de fontes e do princípio da vedação ao retrocesso na seara consumerista. Utilizou-se o método dedutivo de investigação, a partir de pesquisa bibliográfica nacional e estrangeira, tendo como resultado que a limitação do quantum indenizatório à título de danos materiais e a redução do prazo prescricional para ajuizamento de ação reparatória ferem de morte a ideia de integração das normas (CDC e Convenção de Varsóvia / Montreal), bem como retrocedem socialmente os direitos do consumidor, transferindo à parte mais vulnerável da relação o risco do negócio, ao qual deve ser suportado pelo fornecedor.
