Abstract
French Abstract: Le terme « secret ministeriel » fait reference a l’ensemble des regles de nature politique et juridique qui protegent la confidentialite des deliberations et des documents du Cabinet dans les juridictions de type Westminster. Cet article se fonde sur les notes d’un cours introductif sur le secret ministeriel ayant ete enseigne au ministere de la Justice du Canada de 2011 a 2017. L’objectif de ce cours consistait a initier les juristes a l’emploi du Gouvernement du Canada au regime legislatif protegeant le secret ministeriel au niveau federal. Il repondait a un besoin important etant donne la penurie de litterature sur le sujet. Le cours ne se voulait pas une critique du regime legislatif; il cherchait plutot a exposer les regles pertinentes en la matiere et le contexte general dans lequel ces regles s’inserent. Cet article vise a rendre accessible a un plus grand auditoire le contenu de ce cours. Il se divise en trois parties. La premiere partie presente la protection du secret ministeriel en vertu des conventions constitutionnelles. La deuxieme partie traite de la protection juridique du secret ministeriel. Enfin, la troisieme partie examine specifiquement le regime legislatif etabli par le Parlement du Canada aux articles 39 de la Loi sur la preuve au Canada et 69 de la Loi sur l’acces a l’information. English Abstract: The term “Cabinet secrecy” refers to the political and legal rules that protect the confidentiality of Cabinet deliberations and documents in Westminster jurisdictions. This article reflects the notes of an introductory course on Cabinet secrecy taught at the Department of Justice Canada from 2011 to 2017. The objective of the course was to introduce government lawyers and paralegals to the statutory framework protecting Cabinet secrecy at the federal level. It fulfilled an important need, given the dearth of literature on the subject. The course was not intended to criticize the statutory framework; rather, it sought to explain the rules governing Cabinet secrecy and the context in which these rules operate. This article seeks to make the contents of the course accessible to a broader audience. It is divided into three parts. The first part deals with the political protection of Cabinet secrecy under constitutional conventions. The second part examines the legal protection of Cabinet secrecy under common law and statute law. Lastly, the third part focuses specifically on the statutory regime established by Parliament pursuant to sections 39 of the Canada Evidence Act and 69 of the Access to Information Act.
