Abstract
L’auteur Honoré de Balzac (1799–1850) a bénéficié d’une formation d’avocat et son expérience juridique s’est traduite jusque dans ses romans. Tout comme il était en avance sur son temps dans son art, il l’était tout autant dans ses observations sur le droit. Dans cet article, nous examinerons comment ses observations sont des précurseurs de perspectives critiques et modernes du droit. Nous mettrons l’accent sur trois aspects de cette critique : son adoption du réalisme juridique (englobant aussi le scepticisme juridique), son analyse sociologique du droit et sa critique déconstructionniste de celui-ci. Nous recenserons aussi des ressemblances entre sa perspective et celle de réalistes juridiques américains tel Oliver Wendell Holmes, de sociologues comme Pierre Bourdieu, Patricia Ewick et Susan S Silbey, et du déconstructionniste Jacques Derrida.
