Abstract
Les transformations de l’organisation de l’action collective de lutte contre les changements climatiques sont marquées par la présence grandissante des entités infraétatiques et non étatiques. C’est dans ce contexte que l’architecture du marché commun du carbone de la Western Climate Initiative a émergé. Elle repose sur l’Entente concernant l’harmonisation et l’intégration des programmes de plafonnement et d’échange de droits d’émission de gaz à effet de serre, que la Californie, le Québec et l’Ontario ont signée à l’automne 2017. L’architecture proposée dans cette Entente est-elle cependant à même de fournir au marché du carbone les fondations juridiques et institutionnelles nécessaires à sa maturation et à l’atteinte de ses objectifs environnementaux et économiques ? Dans une perspective québécoise, le présent article vise à faire ressortir de manière détaillée les fonctions institutionnelles de l’Entente de liaison et à mettre en lumière les enjeux juridiques soulevés par leur mise en oeuvre.
