Abstract
La Corte di cassazione, nonostante si sia recentemente occupata della utilizzabilita dei risultati probatori acquisiti tramite l’intercettazione delle “chat BlackBerry”, non pone particolare attenzione in merito alle effettive modalita di assunzione dei dati ivi contenuti ritenendo che, a fronte di una attivita interamente compiuta sul territorio dello Stato, il ricorso allo strumento rogatoriale non si appalesi in alcun modo necessario. A cio non osta il fatto che l’operazione di decodifica dei dati cifrati end-to-end, ovvero dal terminale al server BlackBerry, avvenga interamente in Canada, nella sede della societa medesima, cosi legittimandosi un protocollo di messaggistica del tutto inintelligibile e che depaupera nei contenuti il ruolo, nonche la funzione, della c.d. “chain of custody”.
