Cet ouvrage d'Élodie Bordes se présente comme une étude sur la place qu'occupe le silence dans le droit, mais, plus profondément, l'auteure y défend une approche réaliste et pragmatique du droit au travers d'une réflexion interdisciplinaire combinant philosophie du langage, philosophie des sciences et philosophie du droit.L'argument principal de l'ouvrage se déploie en réponse à la perte de sens du droit qui découle, pour l'auteure, de deux états de fait.D'abord, cette perte serait inhérente à l'usage même du langage 1 , ce qui s'observe de deux façons.Cela se manifeste premièrement par la signification que l'on peut parfois associer au mutisme des différents opérateurs juridiques (incluant la figure du juge, du citoyen, du justiciable et du législateur) 2 en ce sens que l'acte de se taire peut en soi être porteur d'une signification.On peut notamment penser au fait que, pour certains auteurs, lorsque les juges rendent un jugement, ils devraient avoir l'obligation de taire leurs opinions personnelles pour se ranger sous l'autorité de la loi imposée par le législateur.Conséquemment, on considère traditionnellement que les juges se doivent de limiter leurs raisonnements à des justifications ______________ * L'auteur est étudiant au doctorat en philosophie
