Abstract
S’inspirant de la démarche élaborée par Michel Foucault sur l’histoire du présent, cette note de recherche propose l’esquisse préliminaire d’une généalogie du projet de justice pénale internationale entendu comme réponse au problème posé par la transgression des lois et coutumes de la guerre. Cette généalogie entend rendre problématique l’origine fréquemment affirmée de ce projet au lendemain de la Première Guerre mondiale. Plus spécifiquement, l’objectif consiste à proposer un cadre permettant d’amorcer la généalogie de ce projet – et des catégories sur lesquelles ce projet repose – de manière à mettre en lumière les conditions ayant rendu possible la mise en place d’un arrangement institutionnel fondant ensemble une raison légale, une charpente juridique, une motivation politique et un impératif moral fonctionnant comme un dispositif de savoir-pouvoir.
