The EU is seeking to expand its portfolio of bilateral trade and investment agreements with third countries. Two such agreements, the CETA between Canada and the EU and the TTIP (the negotiations for which between the European Union and the United States began in 2013) include intellectual property (IP) rights in the list of investments protected by them. If implemented, the enforcement of this protection would be entrusted to arbitration tribunals or to a special court for the protection of investments. This chapter examines the implications of these provisions for the regulation of IP by the EU or its Member States and for the implementation of a balanced and effective intellectual property law in Europe.
