Abstract
Este artigo objetiva analisar o direito ao suicídio assistido. O suicídio assistido consiste em por fim à própria vida, seguindo as informações recebidas de um médico, o que significa que a própria pessoa causa sua morte. A autonomia significa autodeterminação, pela qual a pessoa constrói sua vida de acordo com suas preferências. Baseado no respeito à autonomia, uma pessoa capaz enfrentando uma doença terminal ou uma doença incurável, que lhe cause sofrimentos, tem o direito de escolher morrer, depois de receber as informações necessárias para a prática do ato. No Brasil, o suicídio assistido é caracterizado como crime de induzimento, instigação ou auxílio ao suicídio, previsto no artigo 122 do Código Penal. Tendo em vista que vários países europeus, cinco estados norte-americanos, Quebec e a Colômbia permitem a assistência ao suicídio, praticada de acordo com o procedimento previsto na lei, em respeito à autodeterminação da pessoa e considerando que viver é um direito e não uma imposição, a prática do suicídio assistido, com finalidade exclusivamente altruísta, no Brasil, poderia ser considerada conduta não punível.
