L’objectif de l’article qui suit est d’apprécier le potentiel du contrat intelligent pour devenir un nouveau vecteur de confiance dans le domaine contractuel. Pour ce faire, l’auteur présente et analyse ce phénomène récent ayant émergé à la marge de l’essor de la technologie de la chaîne de blocs (blockchain). Le contrat intelligent est le fruit de l’utilisation de deux procédés techniques : l’informatisation du contenu contractuel et le recours à la technologie de la chaîne de blocs. Ces deux initiatives ont donné naissance à un contrat infalsifiable dont l’exécution se révèle automatique et transparente. Même si le contrat intelligent, en raison notamment de limites inhérentes à l’informatisation du contenu contractuel, ne peut pas apporter une solution définitive au problème de confiance, force est de constater qu’en améliorant la transparence et en garantissant l’exécution conforme du contrat, lorsque cela est possible techniquement, il peut contribuer positivement au rétablissement du climat de confiance entre les parties.
