Abstract
De ontkoppeling van kiesrecht en ingezetenschap in Canada Bij de herziening van de Grondwet in 1983 is het kiesrecht voor de leden van de Tweede Kamer der Staten-Generaal ontkoppeld van ingezetenschap. In Canada heeft deze ontkoppeling van kiesrecht en ingezetenschap plaatsgevonden in januari 2019, bij wege van de uitspraak van het Supreme Court in de zaak Frank v. Canada . In deze bijdrage staat de vraag centraal op welke wijze het Supreme Court in dit arrest tot het oordeel komt dat de Canadese Kieswet op dit punt in strijd is met het Charter of Rights and Freedoms.
