Abstract

Cet article traite de l’anti-syndicalisme patronal et propose une analyse de la jurisprudence issue des cas entendus par les commissions des relations du travail de deux provinces canadiennes, le Quebec et l’Ontario. Plus specifiquement, notre analyse porte sur 145 decisions dans lesquelles il a ete reconnu par les tribunaux competents que les employeurs avaient eu recours a une ou plusieurs strategies anti-syndicales ayant des effets discriminatoires. Nos resultats mettent en evidence la large palette des tactiques utilisees par les employeurs pour combattre la syndicalisation au travail, et ce, lors des differentes etapes de la vie d’un syndicat au sein d’une entreprise. Ils montrent une nette preference pour les strategies les plus agressives, celles qui visent la suppression pure et simple des syndicats. Ils attestent enfin que les pratiques de discrimination syndicale ciblent le plus souvent un seul salarie, mais peuvent aussi parfois viser un groupe, voire l’ensemble des salaries.
