Abstract
Il n’existe pas de définition légale des partis politiques, libres de se créer et d’agir comme ils le souhaitent. Au sens juridique du terme, les partis sont des organisations de droit privé. Les rapports entre leurs membres, la désignation de leurs dirigeants, les investitures électorales relèvent de la réglementation sur les associations et donc de la compétence du juge judiciaire. Ils n’exercent pas de mission de service public. Seule leur participation à la vie politique permet à la loi de les assujettir au respect de l’ordre démocratique et de la légalité de leur action, sous le contrôle du juge administratif.
