Abstract
Les limitations administratives apportées aux modes d’utilisation des sols par le droit de l’urbanisme créent une situation d’hétéronomie juridique défavorable, a priori, au droit de propriété immobilière. Présenté comme le droit des atteintes légales à la propriété foncière, le droit de l’urbanisme est généralement perçu comme ne pouvant et ne faisant que restreindre les attributs du droit de propriété. Cette lecture orthodoxe omet les finalités d’intérêt général poursuivies par la réglementation administrative de l’urbanisme et les compensations que les règles et servitudes d’urbanisme procurent aux propriétaires en termes de production de zones constructibles et de terrains à bâtir.
