Abstract
Le présent article s’intéresse largement à la production de la connaissance en droit. Pour ce faire, il remet en question la notion de « doctrine » en droit civil et cherche à mieux comprendre ce qui distingue ce mode d’écriture d’autres discours sur le droit positif. La Loi sur la capacité juridique de la femme mariée a été adoptée en 1964 et est venue modifier la structure familiale québécoise jusqu’alors en place. Autour d’un objet commun, soit la capacité juridique des femmes mariées, l’analyse féministe ici proposée compare les textes des militantes féministes avec ceux de juristes reconnus. Cette comparaison révèle de nombreuses similitudes entre les deux groupes de textes, et également des différences significatives. L’auteure souhaite essentiellement démontrer que la différence la plus importante entre ces deux types d’écrits n’est pas leur caractère militant ou non, mais plutôt le type d’intérêts défendus. Alors que les auteures féministes affichent ouvertement leur volonté de changer le droit vers l’obtention d’une plus grande égalité entre les conjoint.es, les textes de doctrine utilisent la technique juridique pour défendre un système familial qui repose sur une hiérarchie en faveur du mari et du père.
