Abstract
The environmental and climate problems represented by global warming and a sharp decline in Arctic sea ice have led to global interest in the Arctic, centered on new sea routes(trade routes) and vast hydrocarbon resources(oil and natural gas) on the Arctic coast. This led to concerns and anxiety that sooner or later the Arctic will be an arena of competition and conflict for resources and routes, a forum for discussion on environment and climate. However, the United Nations Convention on the Law of the Sea(UNCLOS), the Constitution of the Oceans, provided the legal framework for the rapidly changing Arctic Ocean governance.In this paper, to clarify the relationship between the Convention and the Arctic jurisdiction, the Arctic Ocean region will be divided into five as follows. Atlantic Arctic Gateway, Eurasian ① ② Arctic, ③Pacific Arctic Gateway, ④North American Arctic, ⑤Central Arctic Ocean.The four issues addressed by the Convention on the Law of the Sea are particularly relevant to the Arctic. ①Article 234 of the Convention(ice-covered areas), ②PART Ⅲ of the Convention(international straits), ③PART XIII of the Convention(marine scientific research and environmental protection in the EEZ), ④PART Ⅸ of the Convention(regional cooperation). The issues related to the jurisdiction of the Arctic Ocean region are summarized as follows. ①the regime for the maritime boundary and baselines, ②the regime of islands(Article 121), ③the hydrocarbon resources of the continental shelf(Article 76), ④Arctic Ocean beyond national jurisdictionThere are only four important jurisdiction problems in the Arctic, apart from two maritime boundary disputes between Canada and its neighbors. The first is a duplicate claim on the continental shelf beyond the EEZ of Russia and Denmark. Canada will soon join this case. The second is a dispute between internal waters and international straits surrounding the right of passage through the Straits of the Northern Sea Route(Russia) and the Northwest Sea Route(Canada). The third dispute is the status of the EEZ and the continental shelf of the Svalbard archipelago. The fourth issue is the status of the United States, a non-Party to the Convention on the Law of the Sea, as a potential claimant to the seabed beyond the EEZ.Therefore, despite some issues, the present and future governance of the Arctic Ocean can be provided by the Convention on the Law of the Sea, which provides a comprehensive legal order of the oceans.
