Abstract
Résumé La présente contribution vise à s'interroger sur le rôle des affects et des identités dans le processus juridictionnel, à partir d'un exemple tiré du droit constitutionnel canadien. La décision rendue par la Cour suprême du Canada autorise le port du niqab devant les tribunaux canadiens lors d'un examen croisé de crédibilité, en matière criminelle. Cette autorisation est, toutefois, conditionnée à la possibilité d'accommoder cette croyance sincère. Outre pour une systématisation du conflit de droits fondamentaux, cette décision est importante car elle prend le contre-pied des décisions rendues en la matière par les cours européennes. Cependant, s'interroger sur le rôle des affects et des identités, dans la démarche comparative, permet de remettre en question une comparaison différentielle trop rapide en démontrant le partage d'une commune régulation patriarcale du corps féminin et occidentale du corps musulman. Les cours qui ont eu à connaître des conflits portant sur le niqab mobilisent les mêmes ressources identitaires, ce que nous qualifierons de circulation affective du corps musulman.
