À quelques exceptions près, la tendance générale des cours internationales est d'examiner la jurisprudence pertinente des autres cours. La CIJ, la CPI et le TPIY se penchent régulièrement sur les décisions d'autre cours et tribunaux internationaux. Ces organes invoquent constamment la jurisprudence de la CEDH, particulièrement en matière de protection des droits des parties aux procédures judiciaires et administratives, selon le cas. Il s'agit d'un dialogue prétorien « silencieux », mais qui est bien loin d'avoir atteint sa maturité.
