Abstract
Le militaire n’est pas régi par les mêmes règles que ses contemporains. Il doit obéir, prendre des risques, bouger, travailler le jour ou la nuit, le dimanche comme la semaine… Et sur l’ordre de ses chefs et dans le respect de règles propres à son activité (règles nationales et internationales), il a le devoir de se servir de ses armes, ce qui comprend le droit de tuer même avec préméditation, l’obligation de risquer sa vie et le redoutable privilège de commander à ses subordonnés de prendre ce risque. À partir de là, tout un droit qui lui est propre a été construit, avec deux objectifs : le premier est de s’assurer que les ordres seront exécutés, le second de définir un cadre pour l’exercice de la profession militaire qui garantisse que cette exécution des ordres sera optimale.
