Abstract
Ran Hirschl est professeur de sciences politiques et de droit à l'université de Toronto et titulaire de la chaire canadienne de recherche consacrée au constitutionnalisme, à la démocratie et au développement. Ses travaux portent sur le droit constitutionnel comparé et sur le contrôle de constitutionnalité de pouvoir législatif et du pouvoir exécutif. Il est l'auteur de Towards Juristocracy : The Origins and Consequences of the New Constitutionalism (Harvard University Press, 2004 & 2007) et de Constitutional Theocracy (Harvard University Press, 2010). Dans ce dernier ouvrage, il montre que le développement de la théocratie constitutionnelle met en évidence une affinité profonde entre les lois constitutionnelles et la loi religieuse. Il montre également le rôle modernisateur et sécularisant des cours constitutionnelles au sein des régimes théocratiques contemporains. Cet article a pour but de discuter cette thèse en montrant qu'elle peut aussi servir au maintien des régimes non démocratiques en les modernisant.
