Résumé La spécificité de la War on Terror menée sous l'administration du président Bush Jr. réside essentiellement dans le caractère non pénal de la détention, de l'interrogation et du jugement des personnes qualifiées de « combattant ennemi illégal ». Ce concept, qui n'est pas neuf, même en droit américain, est la porte d'entrée doctrinale aux suspensions de droits fondamentaux constitutionnels et conventionnels, manifestant le caractère extrême de la War on Terror. Aujourd'hui, la sortie définitive de la War on Terror serait grandement facilitée par le jugement des responsabilités en cause. La mise à jour de la pratique passée doit donc ouvrir la voie à un traitement contentieux de l'exécution et de la conception de la War on Terror.
