Abstract
Le 18 octobre 2017, l’Assemblée nationale du Québec vote la loi favorisant le respect de la neutralité religieuse de l’État et visant notamment à encadrer les demandes d’accommodements pour un motif religieux dans certains organismes. Cet article propose une analyse socio-juridique des fondements et des effets de ce texte. Il met d’abord en lumière les réalités juridiques et sociologiques qui ont alimenté le débat sur la laïcité, et donc sur la neutralité de l’État au cours des douze dernières années. Il questionne ensuite ce que la loi reflète de la réalité sociale ou des représentations dominantes qui en sont véhiculées. Montrant, d’une part, que ce texte contribue à stabiliser une représentation associant les accommodements raisonnables au religieux, l’article soutient, d’autre part, qu’il procède d’une conception très limitative de la neutralité, réduite à la régulation de l’expression individuelle des croyances.
