Abstract
The addition of the Canadian Charter of Rights and Freedoms1 to Canadian constitutionalism was transformative, bringing to the fore a constitutional relationship that, although not entirely absent, had been considerably overshadowed by the focus on institutional and jurisdictional structures and relationships. The new paradigm—a range of constitution-based controls of the relationship between state and citizen—not only shifted a significant class of personal interests from the domain of politics to that of law, it also generated a feedback effect on Canadian constitutional jurisprudence, an effect that might be considered, not altogether flatteringly, modernizing.
