La multiplication des crises internes dans ses États membres a mené l’Union africaine à désigner des médiateurs, chargés d’amener les parties à régler leurs différends par des moyens pacifiques. Mode politique de règlement des différends, la médiation semble n’obéir qu’à des dynamiques politiques. Pourtant, on note un début de règlementation de ce mode de règlement des litiges, même si c’est encore à travers des instruments relevant de la soft law. La question qui se pose dans la présente étude est celle de savoir à quelles règles obéit la médiation de l’Union africaine lorsqu’elle intervient dans le règlement des crises internes de ses États membres. Il serait difficile d’affirmer que la médiation est laissée à l’entière volonté des parties et du médiateur, alors que c’est dans le cadre d’une organisation internationale qu’elle se déroule. En prenant appui sur les éléments factuels et à travers l’analyse des divers instruments qui tentent d’encadrer actuellement la médiation, la présente analyse démontre que même si ses résultats demeurent mitigés en matière de résolution des crises internes aux États, la médiation est un mode de règlement des litiges en cours de règlementation.
