Abstract
En France comme au Canada, une personne qui n’a pas encore fait l’objet d’une déclaration de culpabilité peut être placée en détention provisoire afin de s’assurer du bon fonctionnement de l’enquête et de la justice ou pour des raisons de sécurité. Le nombre de prévenus détenus et le temps passé en détention provisoire sont en augmentation dans les deux pays, ce qui entraîne une surpopulation carcérale importante. Dans son texte, l’auteure constate les incidences d’une telle mesure sur les droits des justiciables, notamment ceux qui relèvent du droit à un procès équitable. C’est en particulier à cause d’une anticipation de la question de la culpabilité et de la peine au stade de la décision sur le placement en détention provisoire que les personnes détenues provisoirement sont atteintes dans leurs droits. Or ces différentes répercussions ne touchent pas toujours de manière identique tous les justiciables, ce qui, en sus, nuit à leur droit à l’égalité devant la loi.
