Ce mémoire traite du respect des engagements internationaux pris par le Canada en matière de lutte contre la traite des personnes à des fins d’exploitation sexuelle. Il propose une analyse des mesures nationales adoptées par ce dernier pour lutter contre ce fléau, conformément aux obligations découlant de la Convention contre la criminalité transnationale organisée et de son Protocole additionnel visant à prévenir, réprimer et punir la traite des personnes, en particulier des femmes et des enfants de 2000. Cette analyse en deux temps débute par l’examen du cadre normatif international relatif à la traite des personnes développé au cours du XXe siècle. Cet encadrement démontre que le phénomène, autrefois interprété à partir de la question prostitutionnelle, puis des droits de l’homme, est aujourd’hui appréhendé à travers le prisme de la criminalité transnationale organisée. Selon cette approche privilégiée par les Nations Unies, les États doivent adopter une stratégie de lutte contre la traite s’articulant autour de quatre piliers : prévention, poursuite, protection et partenariat. La stratégie canadienne de lutte contre la traite des personnes qui est ensuite examinée dévoile une prise en compte accrue du droit international par le législateur canadien, notamment dans le domaine du droit pénal. Malgré les progrès effectués, un tour d’horizon des mesures d’application de la loi et de protection des victimes depuis le début des années 2000 démontre un important déséquilibre entre les volets répressifs et humanitaires de cette stratégie.
