Abstract
Les traités économiques et commerciaux du XXIe siècle, caractérisés par leur vocation à réglementer des secteurs de plus en plus étendus et parfois seulement connexes au commerce international, rendent incontournable, dans un contexte fédéral, la participation des entités fédérées à leur élaboration et à leur application. L’Accord économique et commercial global (AECG) entre le Canada et l’Union européenne n’échappe pas à cette tendance, comme en témoigne le choix de faire participer directement, pour la première fois, les provinces canadiennes à certaines séances officielles de négociation. L’objectif de ce mémoire est d’examiner, à la faveur des principes du fédéralisme et de la démocratie, les mécanismes de consultation et de participation provinciale et parlementaire employés durant le cheminement de l’AECG au Canada. Cet examen, sous l’éclairage des expériences des fédérations de Belgique et d’Allemagne en pareille matière, permettra en conclusion d’identifier des pistes de solution pour améliorer le processus canadien de conclusion et de mise en œuvre des traités.
