L’élargissement du domaine de compétence des banques et le renforcement du secret bancaire qui est un système de protection des renseignements personnels, ont tous les deux été à l’origine de la croissance du secteur économique, notamment le secteur bancaire. Cependant, ces avantages offerts à la clientèle bancaire ont fini par constituer un stimulant pour le déroulement de la fraude financière, particulièrement le blanchiment d’argent. Eu égard à cette situation, la communauté internationale luttant contre le blanchiment d’argent a réalisé que sa lutte ne pourrait être si efficace que par une prise de conscience et par l’intégration des professions impliquées directement par le problème de l’argent sale. Pour ce faire, elle a décidé de confier aux « intermédiaires financiers », y compris les banquiers, le soin de respecter un certain nombre d’obligations telles l’obligation de déclaration des opérations douteuses à un organisme créé à cette fin d’où la levée du secret bancaire et l’obligation de surveillance de façon continue des opérations effectuées par la clientèle bancaire. Par l’entrée en jeu de ces nouvelles obligations, chaque banquier a fini par jouer le rôle d’auxiliaire à la police des circuits financiers et par conséquent tout manquement de sa part à une de ses obligations encourra sa responsabilité et sera sévèrement réprimé.
