Abstract
Yabancılık unsuru içeren kambiyo senetlerin şekline uygulanacak hukukun tespiti için TTK'da bir düzenleme vardır.TTK m. 767/1'de poliçe ile yapılan taahhütlerin şekli (keşide, ciro, kabul vd.), taahhüdün yapıldığı ülkenin hukukuna tabi olduğu ifade edilmiştir.Bono ve çek için de aynı kuralın uygulanacağı TTK'da düzenlenmiştir.Ancak, kambiyo senedinin şekli geçerliliğine sadece bu kuralın uygulanması, senedin geçerliliğini ortaya koymada bazı problemlere neden olabilir.Bu oluşturabileceği problemleri önlemek için ilgili maddenin devam eden fıkralarında tamamlayıcı kurallara yer verilmiştir.Bu çalışmada, TTK m. 767/3'de ifade edilen --Bir Türkün, yabancı ülkede poliçeyle borçlanması, Türk hukukunun gösterdiği şekle uygun bulunduğu takdirde, Türkiye'de başka bir Türke karşı geçerlidir--tamamlayıcı kuralının 21. yüzyılda ihtiyaçlara cevap verip vermediği ve yeterince kapsayıcı olup olmadığı değerlendirilecektir.
