Abstract
En avril 2018, le Conseil d’Etat admet qu’un décret gouvernemental puisse retirer la nationalité française à une femme (mariée à un citoyen français) qui refuse - en raison de ses croyances musulmanes - de serrer la main à un représentant de l’Etat lors de la cérémonie d’accueil. En l’espèce, il valide le décret à l’aune d’une justification particulièrement brève. Même si les décisions du Conseil d’Etat ne sont pas connues pour être particulièrement longues, l’économie ici faite par le juge administratif de toute forme de justifications approfondies étonne d’autant plus que la question posée est particulièrement sensible. C’est la raison pour laquelle il apparaît justifié de s’arrêter sur cette décision et, plus largement, de s’attarder sur la manière dont le droit français concilie désormais le droit à l’acquisition de la nationalité française (en raison notamment du mariage) avec une pratique stricte de la religion (musulmane notamment). Pour le dire en d’autres termes, cela justifie qu’on s’attarde sur la manière dont il concilie aujourd’hui le respect des principes du droit de la nationalité (qui impose notamment une assimilation du demandeur à la société française) et la liberté religieuse.
