 Az itt közölt esszé szerzője Bjarne Melkevik, a Montrealtól nem túl messzire fekvő Québec város Laval Egyetemének professzora. Talán nem túlzás azt mondani róla, hogy a jelenlegi kanadai francia nyelvű jogfilozófia egyik legfontosabb alakja. Melkevik professzor nem csak Québecben ismert, hiszen könyveit és tanulmányait számtalan nyelvre lefordították. A gazdag életmű részét képező egyik könyv Jevgenyij Pasukanisz jogelméletét mutatja be tárgyilagosan, nemzetközi perspektívába illesztve (elsősorban a Carl Schmitt által is kedvelt Maurice Hauriou munkásságával összevetve), és nemegy- szer kritikai szellemben. A szovjet szerzőt végső soron ahhoz a szociologizmust hirdető irányzatba sorolja Melkevik, ahová Roscoe Poundot is szoktuk. A jogfilozófus egy másik műve Habermasról szól, és azt vizsgálja, hogy a német filozófus kom- munikációelméletébe miként ágyazódik bele a jogfilozófiai nézetrendszere. Jürgen Habermas szerint a jog egyszerre tekinthető társadalmi intézménynek és az egyéni életvilág szférája felé irányuló közvetítő közegnek. A jogi érvényességet ezért szerinte diszkurzívan kell megalapozni. Ezt, ahogyan a tanulmányban részletesen is kifejtésre kerül, Melkevik is így látja. Egy jogállam tehát kommunikatívan akkor igazolt, ha az egyének életvilága képes egymással értelmes kommunikációt kialakítani úgy, hogy eközben a társadalmat integráló tényezőként a szolidaritás a pénz- és a közhatalom felett is legitim módon uralmat gyakorol.
