Abstract
L’auteur examine l’obligation de motivation dans le système juridique italien, à partir d’une reconstruction des quatre « modèles théoriques » qui ont conditionné son développement entre la fin du XIXe siècle et le XXe siècle. Le cadre juridique de la motivation est ensuite examiné, introduit par la loi nº 241/1990. Sont enfin approfondis les problèmes liés au champ d’application de l’obligation de motivation et aux défauts qui caractérisent l’acte sans motivation ou motivé de manière incomplète.
