Abstract
Les discussions autour du mariage pour les couples de même sexe permettent de s’interroger sur le contenu du mariage revendiqué. Pour l’essentiel c’est l’institution du mariage qui est invoquée tant par les couples de même sexe que leurs opposants attachés à un mariage hétérosexuel. Or, l’étude du droit positif démontre que ce mariage traditionnel n’est plus. Au fil des dernières décennies, le mariage est devenu un mode de conjugalité dont les spécificités ne font que s’amoindrir.
