Abstract
Le droit du travail est plongé dans la tourmente dans plusieurs grands pays industrialisés à économie de marché. Cette « crise » du droit du travail est apparue bien avant la crise financière de 2007-2008 et ses suites. En fait, la crise financière a accentué le recul du droit du travail vers ses formes initiales, contractuelles et civilistes. La méthode historico-comparative peut s’avérer ici éminemment féconde, surtout si l’on pense au précédent de la crise économique de 1929. Dans cette perspective, nous considérerons un texte marquant de Hugo Sinzheimer sur la « crise du droit du travail » dans l’Allemagne de Weimar, et une étude d’Otto Kahn-Freund relative à la fonction changeante du droit du travail. Les travaux de Sinzheimer et de Kahn-Freund seront reliés à la notion de « constitution du travail », que notamment Max Weber développa dans un sens empirique, lequel trouve son prolongement dans des travaux importants de Thilo Ramm, travailliste de réputation internationale.
