Abstract
La pluralité des ordres juridiques est un thème important en sociologie et en anthropologie du droit. Ce thème est, cependant, longtemps demeuré dans l’ordre du discours théorique et n’a, par ailleurs, pas donné lieu à beaucoup de recherches empiriques. Les juristes qui font de la sociologie du droit ont évidemment tendance à privilégier l’ordre juridique étatique, qui leur est particulièrement familier et qu’ils considèrent généralement comme le seul ayant un caractère « vraiment » juridique. Les sociologues du droit — et bon nombre d’anthropologues — ont, quant à eux, tendance à demeurer à l’intérieur de la notion du droit des juristes, surtout dans leurs études empiriques. Il s’agit là d’une faiblesse de la sociologie du droit, qui doit être corrigée, d’où l’intérêt et la pertinence d’une analyse consacrée à la pluralité des ordres juridiques. Nous débuterons en retraçant la tradition du pluralisme juridique en sociologie du droit. Nous discuterons ensuite du phénomène des ordres juridiques non étatiques, ces derniers faisant particulièrement problème pour les juristes. Cette démarche nous conduira enfin à reconnaître que l’ordre juridique étatique, considéré en lui-même, est également tributaire du pluralisme juridique. En filigrane, c’est la question des rapports pouvant exister entre les ordres juridiques étatiques et non étatiques qui se trouve posée.
